    Finally, shares of Merck (NYSE: MRK  ) increased by 0.84% today on mixed news. The company announced that it would maintain its current quarterly dividend of $0.43 per share for another quarter, but Forbes is reporting that, based on the most recent data which comes as of July 15, 2013, Merck is now the most-shorted Dow component, overtaking Intel.�Despite the large short interest, the announcement that the drug company will maintain its current dividend was enough to help move shares higher, as Merck only experienced slightly more than half its average trading volume, 10 million shares, while the three-month average is 18 million. But, as for Merck, that number is likely distorted to the high end due to a few extremely high-volume days back on June 7, 10, and 11. During those three days, an average of 50 million shares trading hands.

    Many technology companies have overhanging lawsuits and, very often, they are dismissed, or have minimal impact. For example, Freescale Semiconductor, (NYSE: FSL  ) filed a complaint against Marvell, and then Marvell filed a complaint against Freescale, only to have both complaints dismissed. However, investors may be sensitive to this sort of thing with respect to Marvell given that, unless Marvell can successfully appeal the judgment made against it in the CMU case, it stands to fork over about $1.54 billion in past damages and post-judgment royalties. It would also need to pay ongoing royalties on the sale of hard disk controller chips, although it would probably find a way to design around those patents pretty quickly in this case.�

    This question really piqued my interest. Intuitively, I felt like it was probably true, but I didn’t want to answer the question until I could dig into it a bit more. I thought it would be interesting to have a look at the historical performance of a few publicly-traded general partners versus their limited partner to find out if that hypothesis is supported.

    Consider Kinder Morgan Energy Partners (NYSE: KMP) and its general partner Kinder Morgan  (NYSE: KMI). Over the past year, KMI did indeed outperform KMP, but if we track performance back to the IPO of KMI on Feb. 10, 2011 — KMP outperformed KMI during significant time periods. But both generally tracked each other quite closely in terms of returns.


    Next consider Energy Transfer Partners (NYSE: ETP) and Energy Transfer Equity (NYSE: ETE), which owns the general partner and went public in 2006. ETE has significantly outperformed ETP since its IPO, particularly over the past four years:


    But it is important to note that ETE also has interests in Sunoco Logistics Partners (NYSE: SXL) and Regency Energy Partners (NYSE: RGP).
