After three straight days of 100-point swings last week, the Dow Jones Industrial Average (DJINDICES: ^DJI  ) finally settled down on Monday. Financials stood out as Europe's central bank reassured markets, vowing to cut interest rates to new lows if the economy needs further stimulation moving forward. But a major settlement right here in the U.S. also helped banks rally. The blue-chip index ended the day almost precisely sideways, shedding 5 points, or less than 0.1%, to close at 14,968.

Far and away the standout winner of the Dow, Bank of America (NYSE: BAC  ) shares surged 5.2% after the company agreed to settle all litigation with bond insurer MBIA�for $1.6 billion. The settlement shows the continued resolve of the bank to fix the many legal problems left over after the financial crisis. But B of A didn't just shell out money today -- it also obtained the right to buy nearly 10 million shares of MBIA at about a 33% discount to today's prices�in the next five years.�

    The component maker reported a profit of 36 cents a share, above forecasts for 21 cents, and sales of $167.3� million dollars, beating forecasts for $148.5 million. It also said that it expected full-year earnings to fall in a range of $1.40 to $1.60, well above analyst forecasts for $1.05.

    Baird’s David Leiker and Joseph Vruwink call it a “breakout quarter.” They write:

    Upside across all segments and all line items with 41% revenue surge coming in 10% above expectations. One-half of the beat from revenue with balance split among gross margin, SGA and lower tax rate. Launches going very well, continuing the performance seen in April quarter.

    Automotive results accounted for two-thirds of the upside at the pre-tax line. The upside was spread between stronger revenues ($0.03), gross profits ($0.03) and expense control ($0.02). While North American sales improved 86% on the K2XX launch (we assumed 56% growth), international revenues also contributed favorably with 26% growth in Europe (new business and Ford�� (F) recovery) and 22% growth in Asia.

    Competitor AVX Corp. (AVX) has gained 1.1% to $12.96, while Molex (MOLX) has dropped 0.2% to $29.28 and Amphenol (APH) has ticked up 0.3% to $76.32.

New York manufacturers are less than elated about the Affordable Care Act (ACA), according to a survey released today.

The New York Federal Reserve publishes a monthly manufacturing report made up of survey responses from around 100 executives. The survey is always accompanied by a supplemental section (see "Supplemental Report"), with July's focus on the Affordable Care Act.

Commonly known as "Obamacare," the Act is expected to come into effect in 2014, but so far, 75% of respondents haven't made, or planned to make, changes to their companies' health plans.

The same number indicated that they had yet to make any workforce changes due to the ACA, while 65% don't expect any major employment switch-ups over the next 12 months.

Although many firms responded that their lack of changes was due to health insurance policies already in place, more than 85% of those surveyed expect insurance costs to increase. This prediction is likely the impetus behind 30% saying that other employee benefits will feel the squeeze, as well as 39% predicting higher prices for consumers.

Insurance operations

The Company�� United States public finance insurance business is conducted through National, and its structured finance and international insurance operations are conducted through MBIA Corp. and its subsidiaries. It also issue insurance policies to guarantee the payment of principal and interest on municipal obligations being traded in the secondary market upon the request of a broker or an existing holder of uninsured bonds, where premium is generally paid by the owner of the obligation. In addition, the Company has provided financial guarantees to debt service reserve funds. The primary risk in its insurance operations is that of adverse credit performance in the insured portfolio. It seeks to maintain a diversified insured portfolio and have designed each insured portfolio with the aim of managing and diversifying risk based on a range of criteria, including revenue source, issue size, type of asset, industry concentrations, type of bond and geographic area.

Through the Company�� reinsurance of United States public finance financial guarantees from MBIA Corp. and Financial Guaranty Insurance Company (FGIC), National�� insurance portfolio consists of municipal bonds, including tax-exempt and taxable indebtedness of United States political subdivisions, as well as utility districts, airports, health care institutions, higher educational facilities, student loan issuers, housing authorities and other similar agencies and obligations issued by private entities that finance projects that serve a substantial public purpose. Municipal bonds and privately issued bonds used for the financing of public purpose projects are generally supported by ! taxes, as! sessments, user fees or tariffs related to the use of these projects, lease payments or other similar types of revenue streams. As of December 31, 2012, MBIA Corp. had 899 policies outstanding in its insured portfolio. In addition, MBIA Corp. had 199 insurance policies outstanding relating to asset/liability products liabilities issued by MBIA Inc. and its subsidiaries.

Advisory Services

In the Company�� asset management advisory services business its registered investment advisors provide fixed-income asset management services for third parties and the investment portfolios of the Company and its affiliates (including the wind-down businesses) on a fee-for-service basis. Its advisory services are offered in two product lines, traditional and structured. Within the traditional product line, Cutwater offers cash management, customized asset management, discretionary asset management and fund accounting services to governments, insurance companies (including the Company�� insurance subsidiaries), corporations, pension funds, unions, endowments, foundations and investment companies in both pooled and separate account formats. These services are offered through registered investment advisers, and Cutwater receives asset management and administrative fees as compensation. Within the structured product line, Cutwater manages asset/liability programs and conduits (the wind-down businesses), Collateralized debt obligations (CDOs) and other funding vehicles for banks, insurance companies, program trustees and investment companies, and it earns base and performance fees for its services. Cutwater�� advisory services are offered through two principal operating subsidiaries: Cutwater Asset Management Corp. (Cutwater-AMC), an SEC-registered investment adviser and Financial Industry Regulatory Authority (FINRA) member firm, and Cutwater Investor Services Corp. (Cutwater-ISC), an SEC-registered investment adviser.

Wind-down Business

The asset/liability produc! ts busine! ss historically raised funds for investment through two sources, such as issuance of customized investment agreements by the Company and one of its subsidiaries for bond proceeds and other funds, and issuance of medium-term notes (MTNs) with varying maturities issued by its subsidiary MBIA Global Funding, LLC (GFL). Each of these products is guaranteed by MBIA Corp. In addition, GFL would lend the proceeds of its GFL MTN issuances to MBIA Inc. (GFL Loans). The Company primarily purchased domestic securities and lent a portion of the proceeds from investment agreements and GFL MTNs to its subsidiary Euro Asset Acquisition Limited, which primarily purchased foreign assets as permitted under the Company�� investment guidelines. The Company�� conduit segment is principally operated through Meridian Funding Company, LLC (Meridian) and, formerly, Triple-A One Funding Corporation (Triple-A One). The conduits were used by banks and other financial institutions to raise funds for their customers in the capital markets. During 2012, Triple-A One was liquated. The conduits provided funding for multiple customers through special purpose vehicles that issued commercial paper and MTNs.

The question of successor liability by B of A for Countrywide has come up before, in the recently settled battle between the bank and monoline insurer MBIA (NYSE: MBI  ) . Earlier this year, the insurer filed with the New York courts a very long and colorful presentation in its bid to win summary judgment on this very issue. Despite its effort, however, New York State Supreme Court Justice Eileen Bransten wouldn't rule either for or against�the question, citing disputed facts that needed more scrutiny. But, in a blow to Bank of America, she did decide that the successor liability issue should be heard in New York, rather than Delaware, which was B of A's preferred venue.

Reinsurance

The Company�� reinsurance segment consists of property catastrophe reinsurance, other property reinsurance (risk excess, pro rata, risk solutions and facultative), casualty reinsurance (the United States treaty, international treaty and global facultative) and specialty reinsurance (credit and surety, structured, agriculture and specialty). Property catastrophe reinsurance is written on a treaty excess of loss basis where it provides protection to an insurer for an agreed portion of the total losses from a single event in excess of a specified loss amount. In the event of a loss, contracts provide for coverage of a second occurrence following the payment of a premium to reinstate the coverage under the contract, which is referred to as a reinstatement premium. The coverage provided under excess of loss reinsurance contracts may be on a global basis or limited in scope to selected regions or geographical areas.

Other property reinsurance includes risk excess of loss and proportional treaty reinsurance, facultative or single risk reinsurance and its risk solutions business. Risk excess of loss reinsurance provides coverage to a reinsured where it experiences a loss in excess of its retention level on a single risk basis. Proportional contracts involve close client relationships, including regular audits of the cedants��data. Its risk solutions business writes property insurance risks for a select group of the United States program managers. Insurance

The Company�� insurance segment consists of property insurance, casualty insurance, marine, energy and transportation insurance and financial and professional lines insurance. Assurant, Inc. (Assurant) is a provider of specialized insurance products and related services in North America and select worldwide markets. The Company operates in four segments: Assurant Solutions, Assurant Specialty Property, Assurant Health, and Assurant Employee Benefits. Dental benefit plans provide funding for necessary or elective dental care. Coverage is subject to deductibles, coinsurance and annual or lifetime maximums. In a prepaid plan, members must use participating dentists in order to receive benefits. Assurant Employee Benefits owns and operates Dental Health Alliance, L.L.C., a dental PPO network. The Company also has an agreement with Aetna that allows it to use Aetna�� Dental Access network.     Manulife Financial (MFC) is another stock that's forming an ascending triangle pattern right now. In the case of this $33 billion Canadian financial services firm, resistance comes into play at $18, a price level that's acted as a ceiling for shares since all the way back in July. The buy signal comes on a move through that $18 barrier.

    Whenever you're looking at any technical price pattern, it's critical to think in terms of those buyers and sellers. Triangles, and other pattern names are a good quick way to explain what's going on in a stock, but they're not the reason it's tradable. Instead, it all comes down to supply and demand for shares.

    That $18 resistance level is a price where there has been an excess of supply of shares; in other words, it's a place where sellers have been more eager to step in and take gains than buyers have been to buy. That's what makes a breakout above it so significant -- the move means that buyers are finally strong enough to absorb all of the excess supply above that price level.

    After it happens, I'd recommend keeping a protective stop at $16.50.
